Defeat for Spitzer as Sihpol walks free

Eliot Spitzer, New York State attorney general, suffered the first legal defeat of his US mutual fund trading probe yesterday when a Manhattan jury cleared Bank of America broker Theodore Sihpol of 29 counts of grand larceny, fraud, scheming to defraud, and falsifying business records.

James Yates, a New York supreme court judge, declared a mis-trial on four other counts on which the jury was deadlocked.
